Shop Terms

1. Who we are and what these terms cover

Fixamotor is operated by Softalake Oy, a Finnish limited company (business ID 3661996-4), Ruulahdentie 16 A9, Jyväskylä, Finland. In these terms, "Fixamotor", "we" and "us" mean Softalake Oy, and "you" means the repair business that registers on Fixamotor (the "Shop").

These Shop Terms are the agreement between you and us when you use fixamotor.com and the Fixamotor shop app (the "Service") to receive repair requests from car owners and send them quotes. They apply only to businesses. Car owners use the Service under our separate Terms of Service. How we handle personal data is described in our Privacy Policy.

You accept these terms when you register your Shop. The person registering confirms they are authorised to bind the business.

These terms take effect on the date shown at the top of this page. We keep previous versions and will send you a copy on request.

2. How Fixamotor works for shops

Car owners describe the work their car needs. We send each request to suitable shops, you decide whether to send a quote, and the owner chooses which quote to accept. You pay us a fixed lead fee only when an owner accepts your quote.

You contract with the car owner, not with us. When an owner accepts your quote, the repair agreement is between you and the owner. You are responsible for the work, parts, price, warranty and the owner's consumer rights. Fixamotor is not a party to that agreement and does not take payment for repairs: the owner pays you directly.

We are not your agent or employer. You act in your own name as an independent business. Nothing in these terms creates a partnership, joint venture, franchise or employment relationship.

No guaranteed volume. We do not promise any number of requests, quotes accepted or revenue.

3. Joining and your account

To register, you must be a business that is legally entitled to carry out vehicle repairs in the country where you operate. When you register, you give us:

  • your legal business name, business ID and registered address;
  • your VAT number (only VAT-registered businesses can join);
  • the address of your workshop, the services you offer and the car makes you work on;
  • a contact person, email and phone number;
  • a payment card for lead fees.

We check that your business ID and VAT number are valid in official registers (for example, the EU VIES database) before you can send quotes. We may ask for further documents to confirm your identity or right to trade. Car owners are told that this is what we check, and nothing more.

You must keep this information accurate and update it in the Service when it changes. Some changes, such as a new VAT number, take effect once we have re-checked them.

Staff users. You can invite staff to use your Shop account. Each person needs their own login. You are responsible for everything done under your Shop account, including by your staff, and for removing access when someone leaves. Tell us at support@fixamotor.com straight away if you suspect unauthorised access.

4. Receiving requests and sending quotes

Requests you receive show the car, the work needed or symptoms, photos if added, the owner's first name and approximate location. You do not see the owner's full contact details until they accept your quote. Some requests come from owners who have verified their email but not yet created an account; they can accept your quote once they do, any time before the request expires.

Requests stay open for 30 days. Receiving a request costs nothing, and you are free not to quote. Your response rate affects how many requests you receive (section 9), so if you are not taking new work, pause requests in your settings rather than ignoring them.

When you send a quote, you must:

  • base it on the information in the request and describe clearly what is included;
  • show consumers a total price including VAT, and state any assumptions (for example, "if the brake discs also need replacing, add €X");
  • state how long the quote is valid;
  • not include our lead fee as a separate charge, or add a surcharge because the owner came through Fixamotor.

A quote is your offer to the owner. If inspecting the car shows the request was inaccurate, you may revise the quote, but you must explain why and get the owner's agreement before doing extra work or charging more, as consumer law requires.

5. When a car owner accepts your quote

When an owner accepts your quote, we send you their name and contact details so you can agree a time, and the lead fee for that request is recorded (section 6). Other shops are told the request is closed.

After acceptance, you must:

  • contact the owner within 1 working day to arrange the work;
  • carry out the work as quoted, or explain and agree any changes with the owner first;
  • deal with the owner's questions, complaints and warranty claims yourself.

You may then deal with that owner directly, now and in future; repeat business is yours. What you may not do is ask an owner to cancel their acceptance on Fixamotor and book with you off-platform, or quote outside the Service for a request you received through it, to avoid the lead fee.

6. Lead fees

You pay a lead fee each time a car owner accepts one of your quotes. Nothing else is charged: registering, receiving requests and sending quotes that are not accepted are free.

  • The fee is a fixed amount per type of service, in the currency of the market where your workshop is. It does not depend on the quoted price.
  • The current fees are shown in your Shop dashboard and on our pricing page, and every quote screen shows the fee that applies before you send.
  • The fee is fixed at the moment the owner accepts your quote. Later price changes never affect leads already accepted.
  • Every shop pays the same fee for the same type of service in the same market. There are no individually negotiated fees.

Fees are shown excluding VAT. VAT is added as described in section 7.

We may change fees on 30 days' notice (section 18). We will not introduce a new kind of charge, such as a monthly subscription, without asking for your explicit agreement first.

7. Billing, payment and invoices

When we charge. Accepted leads collect in your account as unbilled fees. We charge them once a month. Before each charge, you can review the fees in your dashboard. A fee disputed before the charge is simply left out of it if the dispute is accepted. You can still dispute a fee after it has been charged, within the time limit in section 8; if the dispute is accepted, we credit it with a credit note.

How we charge. We charge the card you saved, through our payment provider Stripe. By saving a card, you authorise us to charge it for lead fees under these terms without asking each time. You can replace the card at any time in your dashboard.

Invoices. For every charge you receive an invoice by email and in your dashboard, listing each lead, its date and fee.

  • If your workshop is in Finland, we add Finnish VAT at the current rate.
  • If your workshop is in another EU country and you have a VAT number that is valid in VIES, we invoice without VAT under the reverse charge procedure, and you account for the VAT.
  • If your VAT number stops being valid, we may pause your account until it is fixed (section 15).

The VAT number on each invoice is the one on your account when the invoice is created. If a period has no fees to charge after credits, you receive a statement instead of an invoice.

Failed payments. If a charge fails, we will email you and retry. If it is still unpaid 7 days later, we may pause new requests to your Shop until it is paid (section 15). Overdue amounts carry interest at the rate set by the Finnish Interest Act.

8. Disputing a fee

You can dispute a lead fee in your dashboard if:

  • the owner did not respond to you or did not turn up, and the work was not carried out;
  • the request was fake, duplicated, or for work you clearly do not offer according to your profile;
  • the owner cancelled before any work was done;
  • we charged the wrong amount or charged the same lead twice.

Please dispute within 30 days of the owner's acceptance, and give a short explanation. We aim to decide within 5 working days and will tell you the outcome and our reasons.

If you dispute a fee before it is charged, an accepted dispute simply removes it from your next charge. If it has already been charged, we issue a credit note and set the amount against your next charge; if you have no further fees due we refund it to your card.

We may refuse disputes that are clearly unfounded, and we may restrict your account if you repeatedly dispute fees for leads that turned into paid work.

9. How requests are matched and ranked

Which shops receive a request depends on:

  • the distance between your workshop and the location the owner gave;
  • whether you offer the type of work requested;
  • whether you are currently accepting new requests;
  • your average rating from car owners;
  • your response rate, meaning how often and how quickly you reply to the requests you receive.

The first three decide whether you are eligible for a request. Among eligible shops, those with better ratings and response rates are more likely to be chosen. If you are new to Fixamotor and have no rating or response history yet, you are treated as average until you build one.

Car owners see quotes in the order they arrive by default, and can re-sort them by price, distance or rating.

Equal treatment. You cannot pay to rank higher or receive more requests, and the lead fee does not affect ranking. We treat all shops by the same rules. Fixamotor does not run its own workshops or offer repairs in competition with you. If we ever introduce paid placement or treat some shops differently, we will update this section first, with notice under section 18.

10. Reviews and ratings

Only car owners who accepted your quote through Fixamotor can review your Shop. Your rating is the average of all your reviews. We publish all reviews that meet our rules, positive or negative, and you cannot pay us to remove or hide a review.

You must not:

  • write reviews of your own Shop or of competitors, or ask anyone else to;
  • offer owners discounts, gifts or other benefits in return for a review, or for changing or removing one;
  • pressure or threaten owners about their reviews.

If you think a review is fake, breaks our rules or is unlawful, report it to support@fixamotor.com with your reasons. We will review it and tell you what we decided and why.

11. Your profile, content and intellectual property

You keep all rights in your business name, logo, trademarks, photos, texts and quotes ("your content"). We do not acquire ownership of any of it.

You give us a non-exclusive, royalty-free licence, for as long as your Shop is on Fixamotor, to use your content to run and promote the Service. That includes showing your profile and quotes to car owners, and showing your name, logo, location, services and rating on fixamotor.com, for example on pages listing repair shops in your area. When you leave, we stop using your content within 30 days, except in reviews already published and in records we must keep by law.

You confirm that you have the rights to everything you upload, and that your profile is accurate and not misleading.

The Service itself, including its software, design and the Fixamotor name and logo, belongs to us. You may say that you are "on Fixamotor" in your own marketing, but you may not otherwise use our name or logo without permission.

12. Personal data of car owners

We and you are each separate controllers under the GDPR. We are responsible for the personal data we process to run the Service. Once an owner accepts your quote and we pass you their details, you are responsible for how you use that data.

You may use owners' personal data only to:

  • prepare quotes for requests sent to you;
  • carry out, invoice and follow up the work the owner accepted;
  • meet your own legal obligations, such as bookkeeping and warranty.

You may not use it for unrelated marketing unless the owner separately agrees, sell or share it, or add it to other lists. You must keep it secure and tell us without delay if data you received through Fixamotor is lost or accessed without authorisation.

Request details you see before acceptance (car, photos, approximate location) are for preparing your quote only. Do not copy them outside the Service.

13. Data we hold and your access to it

The Service records the requests you receive, the quotes you send, which are accepted, your messages with owners, your reviews and ratings, your response rate, and your fees, invoices and disputes.

What you can access. In your dashboard you can see your requests, quotes, accepted leads, messages, reviews, rating, response rate, fees and invoices for as long as your account is open.

What you cannot access. Data about other shops, including their quotes and prices, and car owners' contact details for requests you did not win.

How we use the data. We use it to run the Service, match requests and calculate rankings (section 9), bill you, handle disputes and prevent misuse. We also use quote data in aggregated, anonymised form, such as average prices for a type of repair in a region, to improve and promote the Service. Aggregated data never identifies your Shop.

We do not sell or share data about your Shop with third parties, other than service providers who process it for us (such as hosting and payments) and authorities where the law requires.

14. Your obligations and acceptable use

You must:

  • hold any licences, registrations and insurance required to carry out vehicle repairs where you operate;
  • comply with consumer protection law, including the rules on price information, extra work and remedies for defective work;
  • treat car owners honestly and professionally, in messages and at your workshop.

You must not:

  • send quotes you do not intend to honour, or misleadingly low quotes designed to be raised after the car arrives;
  • try to avoid the lead fee (section 5);
  • create more than one Shop account per workshop, or share your account with another business;
  • manipulate reviews, ratings or response rates (section 10);
  • use the Service to contact owners for anything other than their request;
  • harass or abuse owners, or post illegal content;
  • scrape, copy or extract data from the Service by automated means, or interfere with how it works.

15. Restricting, suspending and ending your account

You can leave at any time by closing your Shop account in your dashboard or emailing us. Fees for leads accepted before you leave remain payable, and we will send a final invoice. Open quotes are withdrawn.

What we may do, and when. We may take these steps, proportionate to the problem:

  • Pause new requests if a payment is overdue (section 7) or your response rate stays very low. This ends as soon as the cause is fixed.
  • Restrict or suspend your account if you breach these terms, if owners make serious, credible complaints about your conduct, if your business or VAT details can no longer be verified, or if the law requires it.
  • End this agreement if you seriously or repeatedly breach these terms, or for any other reason with notice as described below.

Reasons and notice. When we restrict or suspend your account, we will tell you why at the latest when it takes effect, naming the facts and the rule it is based on. When we end the agreement, we give you the reasons and at least 30 days' notice, unless the law requires us to act faster, or you have repeatedly breached these terms; in those cases we still give reasons.

Your right to respond. You can explain your side or correct the facts by replying to our notice. If that resolves the problem, we lift the restriction straight away.

16. Liability

Your responsibility for your work. You are solely responsible for the repairs you carry out and for your dealings with owners. If an owner or anyone else makes a claim against us because of your work, your quotes or your breach of these terms, you will compensate us for the resulting costs, including reasonable legal costs.

Our responsibility. We provide the Service with reasonable care and skill, but we do not guarantee that it will be uninterrupted or error-free, or that you will receive any particular number of requests.

Limits. We are not liable for indirect or consequential loss, such as lost profit, lost business or lost data. Our total liability to you in any 12-month period is limited to the lead fees you paid us in that period, or €300 if that is more.

This limit does not affect your right to a refund or credit of fees charged in error (section 8).

These limits do not apply to liability for intent or gross negligence, or where the law does not allow liability to be limited.

17. Complaints and disputes

If you have a complaint about the Service, a decision we made about your account, our ranking or our fees, email support@fixamotor.com. We will confirm receipt, look into it and give you a written answer, normally within 10 working days.

As a small enterprise, Softalake Oy is not required by the EU Platform-to-Business Regulation (2019/1150) to run a formal internal complaint-handling system or to name mediators. We offer the route above voluntarily, and we are willing to consider mediation in good faith if a dispute cannot be resolved between us.

Disputes about the repair itself are between you and the car owner.

18. Changes to these terms

We may change these terms or our fees. We will email you and show a notice in your dashboard, explaining what is changing:

  • at least 15 days before a change to these terms takes effect;
  • at least 30 days before a fee increase takes effect;
  • longer where a change requires you to make significant technical or commercial adjustments.

You may close your account before the change takes effect, without any cost other than fees for leads already accepted. If you send a quote after the change takes effect, you accept the new terms. You can also tell us you accept a change earlier.

We may make changes with shorter notice only where the law requires it, or to deal with an unforeseen and imminent danger such as fraud or a security threat. A new type of charge always needs your explicit agreement (section 6).

19. Governing law, language and general provisions

Governing law and courts. These terms are governed by Finnish law. Disputes that cannot be settled by negotiation will be decided by the District Court of Central Finland (Keski-Suomen käräjäoikeus).

Language. These terms are available in English and Polish. If the versions differ, the English version prevails.

Other provisions.

  • If any part of these terms is found invalid, the rest stays in force.
  • If we do not enforce a right straight away, we have not given it up.
  • You may not transfer this agreement to another business without our consent. We may transfer it to another company, for example if Fixamotor is sold, and will tell you if we do.
  • Neither of us is liable for failing to perform because of events beyond our reasonable control.
  • These terms, together with the fee list and the Privacy Policy, are the whole agreement between us about the Service.
